Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the iOS application My Capital & Goals (the “App”), developed by Elizaveta Peshchanskaya (“we”, “us”, or “our”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree with these Terms, please do not use the App.

1. Use of the App

The App helps you track your personal capital and savings goals. Specifically, it allows you to:

• record Places — where your money is stored (balances, currencies, notes);
• set Goals — savings targets with progress tracking;
• view your total capital and how it is distributed across Places;
• configure language, theme, display currency, and exchange rates.

You may use the App only for lawful purposes and in accordance with these Terms.

You agree not to misuse the App, attempt to interfere with its normal operation, reverse engineer it, or use it in any way that may violate applicable laws or regulations.

2. No Financial Advice

The App is provided for personal organization and informational purposes only.

The App does not provide financial, investment, tax, legal, accounting, or professional advice.

Any information you enter, view, calculate, organize, or track in the App is for your own personal use. You are solely responsible for your financial decisions and should consult a qualified professional before making financial, investment, tax, or legal decisions.

3. Local Data Storage

The App stores all user-entered data locally on your device. This includes your Places, Goals, balances, currencies, exchange rates, notes, and app settings.

We do not collect, access, transmit, or store your data on our servers.

You are responsible for maintaining the security of your device and for backing up your data if needed. Deleting the App, changing devices, resetting your device, or changing system backup settings may result in loss of locally stored data.

4. Privacy

Your use of the App is also governed by our Privacy Policy.

The App does not collect personal data from users. Any information entered into the App remains stored locally on your device, subject to your device’s operating system and backup settings.

5. User Responsibility

You are solely responsible for:

• the accuracy of Places, Goals, balances, and exchange rates you enter;
• how you interpret and use information displayed in the App;
• any decisions made based on your own records and goals;
• maintaining backups of your data;
• keeping your device secure.

We are not responsible for any loss, damage, financial outcome, or other consequence resulting from your use of the App or reliance on information stored or displayed in the App.

6. Availability and Changes

We may update, modify, suspend, or discontinue the App or any part of it at any time without prior notice.

We do not guarantee that the App will always be available, uninterrupted, secure, or free from errors.

7. Purchases and Subscriptions

If the App offers paid features, subscriptions, or in-app purchases in the future, all payments, billing, refunds, and cancellations will be handled by Apple through the App Store.

Your purchase may be subject to Apple’s App Store terms, payment policies, and refund rules.

We do not process payments directly and do not have access to your full payment information.

8. Intellectual Property

The App, including its design, features, text, graphics, interface, software, and other content, is owned by or licensed to Elizaveta Peshchanskaya and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works based on the App except as permitted by applicable law.

9. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, we make no warranties or representations, express or implied, regarding the App, including but not limited to warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, or error-free operation.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Elizaveta Peshchanskaya shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of data, loss of profits, financial loss, business interruption, or other losses arising from or related to your use of or inability to use the App.

Your use of the App is at your own risk.

11. Apple App Store Terms

These Terms are between you and Elizaveta Peshchanskaya, not Apple.

Apple is not responsible for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.

Your use of the App must also comply with the Apple Media Services Terms and Conditions and any applicable App Store rules.

12. Termination

We may suspend or terminate your access to the App if you violate these Terms or use the App unlawfully.

You may stop using the App at any time by deleting it from your device.

13. Changes to These Terms

We may update these Terms from time to time.

If we make changes, we will update the effective date above. Continued use of the App after changes means that you accept the updated Terms.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with applicable laws, without regard to conflict of law principles.

Nothing in these Terms limits any consumer protection rights that you may have under the laws of your country or region.
